2. 사건 배경

2012년 11월 30일 기준으로 샌디훅 초등학교에는 부설 유치원에서 4학년까지 총 456명의 어린이가 재학 중이었다.[11] 학교 경비 규정은 당시 갱신되어, 방문자는 영상 모니터를 통해 신원을 확인한 후 개별적으로 출입을 허가받아야 했다. 학교 문은 아침 등교가 끝난 후 매일 오전 9시 30분에 잠겼다.[12]

3. 경찰 대응

4. 범인: 아담 란자

2014년 12월 15일, 총기 난사 사건 희생자 26명 중 9명의 가족은 부시마스터, 레밍턴 암스, 총기 유통업체인 캠포, 그리고 범인이 소총을 구입한 (현재는 폐쇄된) 이스트윈저의 매장인 리버뷰 세일즈를 상대로 코네티컷에서 집단 소송을 제기하여 "미정"의 손해 배상을 요구했다.[190] 이들은 2005년 연방 총기 산업 보호법(PLCAA)의 면제를 주장했는데, 이 법은 일반적으로 이러한 소송을 소송 자격이 없다는 이유로 허용하지 않는다.[191][192] 원고들은 XM15-E2S가 군사 및 경찰 적용 분야에만 적합하며 부시마스터가 이를 민간인에게 부적절하게 판매했다고 주장한다.[192] 2016년 10월 14일, 피고의 소송 기각 신청이 승인되었다. 판사는 연방 및 코네티컷 법에 따라 소장이 유효하지 않다고 판결했다.[196][197][198][199]

가족들은 코네티컷 대법원에 항소했다. 2019년 3월, 법원은 4대 3으로 재판소 판결의 일부를 뒤집고 추가 심리를 위해 사건을 브리지포트 고등 법원으로 환송하기로 결정했다.[200] 법원은 총기 제조업체가 무기를 "부당하고, 비윤리적이거나 위험한 방식으로" 제시하는 광고를 사용했으며, 레밍턴이 "소비자들에게... 그들이 인지하는 적에 대한 공격적인 공격을 시작하도록 권장하는 광고 캠페인을 통해 [자신들의] 공격용 무기 시장을 확대하려" 했다는 것을 보여주는 가족들의 코네티컷 불공정 거래 관행법에 대한 항소가 PLCAA에 의해 금지되지 않았고, 따라서 원고가 재판소에서 사건을 주장할 충분한 자격이 있다고 판결했다. 또한 원고가 총기 회사가 AR-15를 어떻게 마케팅했는지에 대한 내부 문서를 소환할 수 있다고 판결했다.[201] 미국 연방 대법원은 2019년 11월 항소를 기각하여 가족들의 소송이 계속 진행되도록 했다.[202]

2022년 2월 15일, 레밍턴은 7300만달러에 합의하기로 동의했다고 가족 변호사 조시 코스코프가 밝혔다.[204][205]

알렉스 존스는 샌디훅 총기 난사 사건이 조작되었다는 허위 주장을 퍼뜨려 명예훼손 소송을 당했다. 2018년 4월 17일, 라디오 진행자이자 음모론자인 알렉스 존스는 총기 난사 사건으로 자녀를 잃은 세 명의 부모에게 명예 훼손 혐의로 소송을 당했다. 이전에 존스는 샌디훅 총기 난사 사건이 "완전히 가짜"이며 수정헌법 제2조의 반대자들이 저지른 "거대한 사기극"이라고 말했다.[206] 존스는 이후에 그 총격 사건이 실제였다고 믿게 되었다고 주장했다.[207] 2018년 5월 23일, 6명의 가족이 존스의 주장에 대해 추가로 소송을 제기했다.[208] 재판이 시작되기도 전에 텍사스 판사는 존스가 재판 절차와 관련된 증인과 자료를 제출하지 않아 법정 모독 혐의를 인정했다. 결과적으로 존스와 인포워즈는 2019년 10월과 12월에 총 126000USD의 벌금을 부과받았다.[209]

2022년 8월 4일, 존스는 샌디훅 유족에게 409.99999999999994만달러의 보상적 손해 배상을 명령받았고, 2022년 8월 5일에는 추가로 4520만달러의 징벌적 손해 배상을 명령받았다.[214][215][216]

2022년 10월 12일, 코네티컷 주 법원은 존스에게 샌디훅 희생자 가족들에게 9.65억달러의 손해 배상을 명령했다.[217][218]

2019년 10월 16일, 배심원단은 제임스 페처가 쓴 책 《샌디훅에서는 아무도 죽지 않았다(Nobody Died at Sandy Hook)》의 명예 훼손에 대해 레너드 포즈너에게 450000USD를 배상하라고 판결했다. 이 책은 포즈너가 총격 사건의 6살 희생자인 아들 노아의 사망 증명서를 조작했다고 주장했다. 페처는 이 결정에 항소할 것이라고 말했다.[188] 페처는 항소를 청원했지만 기각되었고, 재심리를 청원했지만 이 또한 기각되었다.[189]

5. 2. 총기 규제 논쟁

샌디훅 초등학교 총기 난사 사건은 미국의 총기 규제에 대한 논쟁을 다시 불러일으켰다.[249] 사건 직후, 백악관에 총기 규제 강화를 요구하는 청원이 시작되었고, 총기 규제 옹호 단체들은 기부금이 쇄도했다.[250][251][252]

버락 오바마 대통령은 총기 규제를 자신의 두 번째 임기 핵심 과제로 삼겠다고 발표하고, 조 바이든 부통령을 위원장으로 하는 총기 폭력 대책반을 구성했다.[253][254] 오바마는 총기 구매 시 신원 조회 강화, 공격용 무기 금지, 10발 이상 탄창 금지 등을 제안하며 23개의 행정 명령에 서명하고 12개의 의회 조치를 제안했다.[255][256][257]

반면, 전미총기협회(NRA)는 총기 없는 학교 구역이 오히려 살인자를 유인하며, 총기 금지는 효과가 없을 것이라고 주장했다. NRA는 모든 학교에 무장 경찰관을 배치할 것을 촉구하며, 이를 지원하기 위한 프로그램을 만들겠다고 발표했다.[258]

이후, 2011년 투손 총격 사건의 피해자인 개비 기퍼즈 전 의원은 총기 규제 단체 '책임 있는 해결책을 위한 미국인'을 설립하여 NRA 등에 맞서 총기 규제 여론을 조성하려 했다.[260]

몇몇 주에서는 총기 규제를 강화하는 법안을 통과시켰다. 뉴욕주는 2013년 1월, 총기 난사 사건 이후 처음으로 '안전 탄약 및 화기 시행(SAFE) 법'을 제정했다.[261] 코네티컷주도 2013년 4월, 모든 총기 구매에 대한 신원 조회 의무화, 10발 이상 탄창 판매 금지, 공격용 무기 금지 확대 등을 포함하는 강력한 총기 규제 법안을 통과시켰다.[262][263][264][265] 메릴랜드주 역시 2013년 4월에 총기 규제를 강화했다.[267][268] 그러나 다른 10개 주에서는 오히려 총기 규제를 완화하는 법률을 통과시켰다.[269]

연방 의회 차원에서는 2013년에 공격용 무기 금지 법안[270][271]과 총기 구매 시 신원 조회를 확대하는 법안[272][273]이 발의되었으나, 모두 상원에서 부결되었다.[274]

5. 3. 추모

2013년, 뉴타운 선출 위원회는 샌디 훅 영구 추모 위원회를 임명했다.[302] 위원회는 189개의 디자인 제출물 중에서 SWA 그룹의 댄 애플렉과 벤 왈도가 제작한 디자인을 선택했다. 2021년 4월, 뉴타운 유권자들은 370만 달러의 추모관 건설 예산을 근소한 차이로 승인했고, 2021년 8월 부지 작업이 시작되었다.[302] 2022년 8월에 건설이 완료되었다. 추모관은 희생자 가족들과 함께 비공개 행사를 가진 후 2022년 11월 13일에 일반에 공개되었다.[303] 추모관은 희생자들의 이름이 새겨진 돌로 된 분지와 그 중심에 어린 플라타너스 나무를 특징으로 한다. 매년 세인트 로즈 오브 리마 교회에서 추모 미사가 열린다.[304]
